ETSI-GSMA Intellectual Property Rights Summit 2013

“Tackling Tomorrow’s Technology Challenges”

For the first time ever, ETSI the European Telecommunications Standards Institute, and the GSMA will be joining together to host the ETSI-GSMA Intellectual Property Rights Summit 2013. This invitation-only event, taking place in Shanghai, 26-28 June, will gather the leading IPR experts from major operators and manufacturers across the globe, providing an opportunity to address the Intellectual Property Rights (IPR) challenges affecting the telecommunications industry today.

The ETSI-GSMA Intellectual Property Rights Summit 2013 is a continuation of the GSMA IPR events that began at the 2010 Mobile World Congress in Barcelona, followed by a series of meetings in Hong Kong at Mobile Asia Congress 2010 & 2011 and in Shanghai during Mobile Asia Expo 2012.

Additionally, we are delighted that this year’s event is planned in collaboration with ETSI, an industry-led standards development organisation with a membership of over 700 manufacturers, network operators, service providers, research bodies, regulatory bodies and academia from over 60 countries. ETSI aims to produce globally applicable standards and is recognised by the European Union for information and communication technology (ICT).

27th June 2013, Day One – Panel Discussions (comprising short presentations to introduce the topic, followed by a panel discussion (each panel consisting of approx. 5-6 participants), then opened up to the audience for a Q&A.

9:00 – 9:15 Opening Addresses Formal opening of the event by ETSI by Luis Jorge Romero, Director General at ETSI.
9:15 – 10:15 Session 1: Recent legal developments and trends in Patent Law

  • A global perspective and update of developments in this area
  • US developments - especially the recent changes following the introduction of the American Invents Act and recent cases relating to SEPs, FRAND and anti-suit injunctions;
  • EU developments, including the Unitary Patent and Unified Patents Court, EU Commission intervention in SEPs, explosion of litigation in this sector and the emergence of trolls in the European courts;
  • Asian perspective (Japan/Korea/South East Asia). Special focus on what’s happening in China since its inception into WTO

Presentations by law firms with involvement of Chinese officials and academia in the final segment.

10:15 – 11:15 Session 2: Update on the Unified European Patent CourtKey note by the Rt. Hon. Professor Sir Robin Jacob.

Followed by a panel with GSMA members and associate companies, officials, academia and law firms regarding:

• Latest developments regarding the UEPC.

  • Impact on the telecommunications industry.

11:30 – 12:30 Session 3: Patent quality, patent transactions and their effect on the industryPanel with participation from the GSMA members and associate companies, officials, academia and law firms exploring the following issues:

  • Impact of mergers & acquisitions on market in patents and their effect on the telecommunications industry.
  • Patent quality and effect on the telecommunications industry.
  • The factors driving these deals, such as patent portfolio valuations, defensive strategies, licensing opportunities.
  • Relationship between the capital valuation of patent portfolios and the licence revenue generated by such portfolios, and what this says about the real motivation behind these deals.
  • The valuation of US portfolios as compared with the rest of the world.
  • The rise of so-called trolls and monetisation vehicles

2:15 – 3:45 Session 4: The “Smartphone Wars” - What lessons can be learnt?

  • What lessons can be learnt from the Smartphone wars and what might this mean for the next round of standardisations in the telecommunications industry? What are the incentives to participate?
  • Single patents supporting individual features resulting in disproportionate exposure to injunctions in patentee friendly jurisdictions;
  • Increased vulnerability to patent litigation due to increase from 5 billion to 25 billion devices by 2020 and the real possibility of serious disruptions to essential telecommunication services.

4:00 – 5:00 Session 5: Technology Trends and New Media Panel discussion regarding:

  • Challenges posed by access to the internet on mobile phones
  • Challenges of dealing with copyright in a new media environment, with brief updates on developments in the US, EU and Asia.
  • Structural copyright issues such as the imposition of levies and obtaining global permissions

9:20 – 10:10 Session 1: Remedies in patent infringement actions, in particular the availability of injunctive relief

  • What are the criteria that should apply to the granting of injunctions – are the US Merc Exchange criteria the right approach?
  • Should the criteria be different depending on whether the patent is: (a) trivial (i.e. the technology protected by the patent is a trivial aspect of a device); (b) a non-essential; (c) commercially essential; or (d) standard essential.

  • Are national court systems the right fora for resolving patent-related disputes in this sector? E.g. FRAND issues.
  • What are the pros and cons of other modes of dispute resolution, such as arbitration and mediation?
